ESA Recognition signifies an important form of acknowledgment by the European Space Agency (hereinafter 'ESA' or the 'Agency'), whereby the Agency expresses its symbolic connection to an initiative that it considers to be worthy of appreciation for its scientific, educational or outreach purposes, as well as for its link with ESA space activities. ESA may authorise in this context the use of the ESA Logo, which represents the name, emblem, and heritage of the Agency, in association with the Initiative.

The User will be authorised to use the ESA Logo only upon written authorisation by ESA and upon acceptance of these terms and conditions.

In order to obtain the authorisation to use the ESA Logo in connection with the Initiative, the User shall submit to ESA a formal request in accordance to the terms and conditions below.

Should ESA consider the Initiative of interest and therefore worthy of ESA Recognition, ESA will inform the User by email, within fifteen (15) days, that the authorisation to use the ESA Logo has been granted. In case no formal reply is received from the Agency within fifteen (15) days from the submission of the request, the request will be considered as rejected.

TERMS AND CONDITIONS

The European Space Agency may authorise the use of the ESA Logo in accordance with and upon acceptance by the User of the following Terms and Conditions.

Definitions applicable to the Authorisation:

a) 'ESA Logo' means the Logo and the Agency's acronym "ESA" alone and in association with the Logo, representing the ESA official emblem as displayed at the date of entry into force of this Authorisation under the web link: www.esa.int/esalogo/ and protected as a trademark for products and services belonging to the classes 7, 9, 12, 14, 18, 25, 28, 35, 41 and 42 of the International Classification of Goods and Services under Nice Agreement, 10th edition, as well as under Article 6ter of the 'Paris Convention for the Protection of Industrial Property'.

b) 'Initiative' means an event considered by the Agency as worthy of appreciation for its scientific, educational or outreach purposes, as well as for its link with ESA space activities.

c) 'Promotional Materials' means materials and displays, including webpages, posters, flyers, vlogs, video animations, images, trailers, social media communication, and brochures, that may show or make reference to the ESA Logo, promoting the User's Initiative.

d) 'User' means any public or private entity or natural person of eighteen (18) years or older, having accepted these terms and conditions in order to reproduce and use the ESA Logo.
Right to use the ESA Logo. ESA grants the User a non-exclusive, non-transferable, non-assignable (except as specified under Paragraph 5.b), royalty-free, revocable in case of breach of these terms and conditions, worldwide right to reproduce and use the ESA Logo (hereinafter the 'Authorisation')
The User shall exclusively use and display the ESA Logo in accordance with the terms of this Authorisation, and for the exclusive purpose of the Initiative
The User shall:

a) ensure to use and reproduce the ESA Logo in conformity with the graphic rules described in the ESA corporate identity manual: https://brand.esa.int/assets/logo/;

b) display the ESA Logo, as visible at https://brand.esa.int/assets/esa-logo-authorisation/, in a prominent location on Promotional Materials relating to the Initiative; the statements "With the recognition of the European Space Agency" and "The European Space Agency received no financial compensation for this Initiative" must also be clearly displayed;

c) ensure that the ESA Logo's use is compatible with the reputation, status and objectives of ESA and its Member States;

d) at no cost to the Agency, make drafts and final versions of any Promotional Materials related to the Initiative available to ESA, to obtain the Agency's approval. ESA may, at its sole discretion, withhold approval or grant approval under modified conditions that it considers appropriate.
The User shall not:

a) alter or modify the ESA Logo in any way;

b) during the duration of this Authorisation, permit third parties to use the ESA Logo, except those involved in the production and/or distribution of Promotional Materials related to the Initiative;

c) use the ESA Logo in any way that could imply the endorsement by ESA and/or ESA Staff of any commercial product, commercial entity, process or service, or of any ideology, religion, political doctrine or party or used in any other manner that is not compliant with this Authorisation's terms and conditions;

d) use the ESA Logo in association with any topic incompatible with the role and reputation of ESA as an intergovernmental organisation (such as, but not limited to: tobacco, alcohol, illegal drugs, violence, gambling, weapons, etc.);

e) file in its own name, or the name of its direct or indirect subcontractors, a trademark or domain name identical or similar to the ESA Logo, directly or indirectly through a third party, in any territory whatsoever and whenever.
The User acknowledges that ESA does not provide any warranty with respect to the ESA Logo; it is the User's responsibility to ensure that the ESA Logo is suitable for the purpose of the Initiative.
The User acknowledges that the Agency shall assume no liability in respect of the User's use of the ESA Logo, and, in that regard, hereby agrees to hold ESA harmless for any and all direct or indirect alleged damages.
The User authorises ESA to communicate the Initiative on its own website and on other media channels (such as YouTube, Facebook, Twitter, etc.) and to use, reproduce and display on such channels, for ESA communication purposes, the User's name, logotype, and any recordings of the Initiative, or parts of it.
The User will be granted a right to use the ESA Logo under this Authorisation for the 'duration of use' specified below and confirmed by ESA by email. In any case, the duration shall not exceed a period of two (2) years from ESA's confirmation of the grant of this Authorisation.
Without any prejudice to the ESA Convention, especially its Annex I on Privileges and Immunities, this Authorisation shall be governed and shall be interpreted in accordance with the laws of France. All disputes arising out of, or in connection with this Authorisation shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules. The language of arbitration shall be English. The place of arbitration shall be Paris, France.
The Authorisation shall terminate immediately upon an event of default by the User of an obligation specified in Paragraphs 3, 4, 5, 7, 12 of this Authorisation, where no remedy of such an event of default is agreed between the User and the Agency. Where necessary, the sole means for settling disputes arising from this Authorisation shall be as specified in Paragraph 10.
To the extent applicable to this Authorisation, ESA will comply with its ESA Framework on Personal Data Protection, available on the ESA website at: Highlights of ESA rules and regulations ; and the User shall comply with the Personal Data protection laws and regulations applicable to the User.

Requests for authorisation must be submitted in ENGLISH. Submissions in other languages will not be considered.
